Domstad Cadeaus

Domstad Cadeaus is a trade name of Inspired by Passion. These terms apply to orders placed through Domstad Cadeaus. Inspired by Passion is the legal business behind Domstad Cadeaus.

Article 1. Definitions

In these terms, the following definitions apply:

1. Domstad Cadeaus: the online store and trade name under which, among other things, Utrecht gifts, Dom Tower decor, personalised products and local city products are offered.

2. Inspired by Passion: the legal business behind Domstad Cadeaus.

3. Trader: Inspired by Passion, trading under the name Domstad Cadeaus.

4. Consumer: a natural person who is not acting for purposes relating to a trade, business, craft or professional activity.

5. Customer: any natural person or legal entity that places an order with Domstad Cadeaus.

6. Product: any item offered through Domstad Cadeaus.

7. Custom-made product: a product that is actually made according to the customer's specifications or personally adapted, for example with a name, text, date, photo, engraving or other personal information.

8. Distance contract: an agreement concluded through the online store, email or another means of distance communication.

9. Cooling-off period: the statutory period during which a consumer can exercise the right of withdrawal, unless a statutory exception applies.

10. Right of withdrawal: the consumer's statutory right to withdraw from a distance contract during the cooling-off period.

Article 3. Applicability

1. These terms apply to every offer made by Domstad Cadeaus and every agreement between Domstad Cadeaus and the customer.

2. Before the agreement is concluded, these terms are made available on the website in a way that allows the customer to consult and save them.

3. If additional terms or specific product information apply to a product, they form part of the offer.

4. If a provision of these terms proves invalid or unenforceable, the remaining provisions remain in force.

5. Mandatory consumer rights always take precedence over any provision in these terms that would conflict with them.

Article 4. The offer

1. Domstad Cadeaus describes the products offered as clearly and completely as possible.

2. Product photos and examples are intended to give a good impression of the product.

3. Wood, 3D-printed products, laser engravings and manually finished products may show small natural or production-related differences, such as variations in wood grain, colour, engraving contrast, layer structure or finish.

4. Such normal differences are not considered defects as long as the product complies with the agreement and with what the customer may reasonably expect.

5. Obvious errors, typographical errors and evident mistakes in price or product information do not bind Domstad Cadeaus.

6. For personalisation, the customer is responsible for correctly providing names, texts, dates, photos and other personalisation details.

Article 5. Formation of the agreement

1. The agreement is concluded when the customer accepts the offer and the order is electronically confirmed by Domstad Cadeaus.

2. After placing the order, the customer receives a confirmation at the email address provided.

3. Domstad Cadeaus may refuse or cancel an order in the event of an obvious error, incorrect information, suspected fraud, technical impossibility or when a requested personalisation cannot reasonably be carried out.

4. If an order is cancelled by Domstad Cadeaus after payment, the amount paid for the cancelled part will be refunded.

Article 6. Prices and payment

1. All consumer prices on the website are stated in euros and include VAT, unless expressly stated otherwise.

2. Any shipping costs and other additional costs are clearly shown before the order is completed.

3. Payment is made using the payment methods available during checkout.

4. For an order that has already been confirmed, the agreed price applies, except in the case of an obvious error that is recognisable to the customer.

5. The customer is responsible for correctly entering order, payment and contact details.

Article 7. Production time, shipping and delivery

1. Some products are manufactured, engraved, personalised or finished after the order is placed.

2. The current production time is stated on the product page of the relevant product.

3. The total expected delivery time consists of the production time plus the carrier's delivery time.

4. Domstad Cadeaus processes and ships orders from Monday to Friday.

5. For production planning, 10:00 is the cut-off time on business days. Orders placed after 10:00 are counted from the next business day for planning purposes.

6. Current shipping costs, shipping countries and delivery-time guidelines are stated in the Shipping Policy and on the Domstad Cadeaus shipping page.

7. If a different production time or delivery method is stated for a specific product, that product-specific information applies.

8. If no other delivery period has been agreed, the statutory maximum delivery period applies.

9. In a consumer purchase, the risk of damage or loss generally passes only when the consumer, or a third party designated by the consumer who is not the carrier, has received the product.

10. If a parcel is returned because the customer provided an incorrect or incomplete address, reasonable costs for reshipping may be charged insofar as permitted by law.

Article 8. Right of withdrawal for standard products

1. For standard products purchased online by a consumer, a statutory cooling-off period of 14 days generally applies.

2. The cooling-off period begins on the day after the consumer, or a third party designated by the consumer who is not the carrier, has received the product.

3. Where multiple products from one order are delivered separately, the cooling-off period begins on the day after the final product has been received.

4. During the cooling-off period, the consumer may inspect and assess the product as would reasonably be possible in a shop.

5. If the product has been used beyond what is necessary to establish its nature, characteristics and functioning, a reduction in value may be charged to the extent permitted by law.

6. The consumer can withdraw from the purchase by sending an unambiguous statement to Domstad Cadeaus within the cooling-off period.

7. After giving notice of withdrawal, the consumer has another 14 days to return the product.

8. The direct cost of returning the product following an ordinary withdrawal is borne by the consumer.

Article 9. Personalised and custom-made products

1. The statutory right of withdrawal does not apply to products that are actually manufactured according to the consumer's specifications or are clearly personal in nature, insofar as the statutory exception for custom-made goods applies.

2. Personalisation or customisation may include, among other things, a specially applied name, personal text, date, photo, engraving, personal coordinates or another customer-specific modification.

3. A standard version of a product that can also be ordered in personalised form does not automatically fall under this exception.

4. Choosing a normal standard variant or standard option from the existing range does not in itself automatically make a product custom-made.

5. If a personalised or custom-made product is damaged, incorrectly delivered or does not conform to the order, the customer's statutory rights remain fully applicable.

Article 10. Returns and refunds

1. The conditions for returns and refunds are set out in the official Returns and Refund Policy of Domstad Cadeaus.

2. In the event of a valid full withdrawal, payments received are refunded in accordance with statutory rules, including the standard costs of the original delivery where required by law.

3. Domstad Cadeaus may withhold the refund until the product has been received or until the consumer provides evidence that the product has been returned, whichever occurs first.

4. Refunds are made using the same payment method used for payment, unless another refund method has been expressly agreed.

5. No additional fee is charged for a refund.

Article 11. Personalisation and information supplied by the customer

1. Domstad Cadeaus processes personalisation based on the information supplied by the customer.

2. The customer is responsible for the accuracy of names, texts, dates, photos, logos, symbols, coordinates and other files or information supplied.

3. Domstad Cadeaus is not responsible for an error in personalisation that directly results from incorrect information supplied by the customer.

4. Where a digital proof or design is sent for approval in advance, the customer is responsible for checking it carefully.

5. The customer declares that they are entitled to have photos, logos, images, texts and designs supplied by them used by Domstad Cadeaus for the fulfilment of the order.

6. Domstad Cadeaus may refuse a personalisation request if it is unlawful, infringes third-party rights or cannot or may not reasonably be carried out.

Article 12. Product characteristics and material variations

1. Many Domstad Cadeaus products are designed in-house, 3D printed, laser-cut, engraved, sanded or manually finished.

2. Wood is a natural product. Variations in grain, colour, structure and engraving result may occur.

3. Slight layer lines and small finishing differences may be visible on 3D-printed products.

4. With laser engraving, contrast or colour may vary slightly due to the material, coating, type of wood or surface treatment.

5. These normal material and production variations are not defects as long as the product complies with the agreement.

Article 13. Use and maintenance

1. The customer must use the product normally and carefully.

2. Products made of PLA, PETG or other plastics must be protected from extreme heat, open flames and conditions for which the material is not suitable.

3. Decorative products are intended for indoor use unless the product page expressly states that they are suitable for outdoor use.

4. Wooden products may be sensitive to moisture, heat, dishwashers, aggressive cleaning agents and prolonged exposure to direct sunlight.

5. Damage caused by misuse, an accident, inadequate maintenance or normal wear and tear is not considered a defect for which Domstad Cadeaus is responsible, insofar as permitted by law.

Article 14. Statutory warranty and conformity

1. The customer is entitled to a product that complies with the agreement.

2. Statutory warranty rights and other statutory consumer rights always remain applicable.

3. If a product arrives damaged, is delivered incorrectly or does not meet what could reasonably be expected, contact Domstad Cadeaus as soon as possible.

4. Domstad Cadeaus may ask for photos or additional information to assess the issue.

5. In the event of a justified complaint, an appropriate statutory remedy will be offered, such as repair, replacement, price reduction or refund, depending on the situation and the applicable legal rules.

6. A commercial or manufacturer's warranty can never limit statutory warranty rights.

Article 15. Complaints

1. Complaints about a product, order or service can be submitted via info@domstadcadeaus.nl.

2. Where possible, state the order number and provide a clear description of the complaint. Add photos if relevant.

3. Domstad Cadeaus responds within 14 days of receiving a complaint.

4. If more time is needed for substantive handling, the customer will receive an acknowledgement within that period with an indication of the further handling.

Article 16. Liability

1. Domstad Cadeaus is not responsible for damage arising solely from incorrect or careless use of a product, use contrary to clear instructions or a cause attributable to the customer.

2. Nothing in these terms limits or excludes liability where this is not permitted under mandatory law.

3. Statutory consumer rights, including rights relating to a defective or unsafe product, remain fully applicable.

Article 17. Force majeure and circumstances beyond reasonable control

1. In circumstances beyond the reasonable control of Domstad Cadeaus, such as serious transport disruptions, power outages, fire, sudden machine failure, government measures or material shortages, fulfilment of an order may be delayed.

2. Domstad Cadeaus informs the customer when such a situation has material consequences for the order.

3. This provision does not affect the consumer's statutory rights in the event of non-performance or late delivery.

Article 18. Intellectual property

1. Designs, photos, product images, texts, logos, files and other content of Domstad Cadeaus remain the property of Inspired by Passion or the relevant rights holder.

2. This content may not be copied, sold, distributed or used commercially without permission, unless permitted by law.

3. Where the customer supplies files, photos, texts, logos or designs, the customer declares that their use for the order does not infringe third-party rights.

Article 19. Privacy

1. Personal data is processed to the extent necessary for order fulfilment, payment, shipping, customer service, administration and legal obligations.

2. More information about the processing of personal data is provided in the Domstad Cadeaus Privacy Policy.

Article 20. Applicable law and disputes

1. Agreements with Domstad Cadeaus are governed by Dutch law.

2. This does not limit any mandatory protection that a consumer has under applicable law.

3. The parties will first try to resolve a dispute by mutual consultation.

4. If that is unsuccessful, the dispute may be submitted to the competent court in accordance with the statutory rules.

Article 21. Amendments

1. Domstad Cadeaus may amend these terms for future orders.

2. The most current version will be made available on the website.

3. For an agreement already concluded, the terms that applied when the order was placed will in principle remain applicable, unless an amendment is legally required or the parties agree otherwise.
